P22-M damage suit isinampa vs. Philracom
Nagsampa ang Metro Manila Turf Club, Inc. ng P21.6 million damage suit laban sa Philippine Racing Commission at mga opisyal nito dahil sa diumano’y pagpapasa at pagpapatupad ng 53 ‘unlawful and invalid resolutions’ mula 2015 na nakasira sa industriya ng karera.
Inihain sa Mandaluyong Regional Trial Court nitong Mayo 6 ang civil case sa pamamagitan ni Metro Turf senior vice president at director Jose Alexander Carandang na humihingi ng writ of preliminary injuction para pigilin ang Philracom Board sa implementasyon ng kinukuwestiyong resolutions at ang pagbasura sa mga ito.
Respondents sa kaso sina Philracom chairman Andrew Sanchez, Commissioners Lyndon Noel Guce, Victor Tantoco, Jose Gutierrez Santillan Jr., Bienvenido Niles Jr., Wilfredo J. A. De Ungria, Ramon Bagatsing Jr. at executive director Andrew Buencamino.
Humihingi ang Metro Turf ng actual damages na P6,592,899, exemplary damages na P10 million, at legal costs na aabot sa P5M.
“The implementation of the clearly unlawful and invalid 53 Resolutions, if not immediately restrained or enjoined, will continue to cause grave and irreparable injury to Metro Turf, which has suffered immense losses to the brink of financial failure,” anang petisyon.
Ipinasa umano ng respondents ang mga kinukuwestiyong resolusyon nang walang notice at hearing, bago ipinatupad nang hindi nailalathala ayon sa tinatakda ng batas.
Wala umanong kapangyarihan ang Philracom na maglatag ng arbitrary penalties dahil hindi ito saklaw ng Presidential Decree No. 420 na sumasakop sa ahensiya.
Isang probisyon lang umano sa PD 420 ang nagsasaad ng isang punishable act: “the use of improper devices, drug stimulants of other means to enhance or diminish the speed of horses, or materially harm their condition.”
Walong penal resolutions umano ang inilabas ng Philracom na wala sa itinatakda ng PD 420.
Ayon pa sa Metro Turf, sila lang ang pinag-iinitan ng Philracom.
